General Terms & Conditions of Sale

Proposal Terms
1. This proposal is valid for 30 days from the date of this proposal, at which time the proposal expires. After 30days, MASSIVE reserves the right to reassess quotation pricing before any agreement can become binding.
2. To accept this proposal,a signature is required, acknowledging all terms, conditions, inclusions and exclusions.
3. The signing party asserts that they are authorized to sign on behalf of the purchasing party.

Pricing
4. All prices are provided based on the quantities and measurements in the details provided.
5. Where detail is unavailable at time of pricing, quotes are not binding until confirmation of details.

Ordering
6. Prior to ordering, all shop drawings require signature and confirmation of acceptance from the purchaser.
7. Only items noted in the approved shop drawings will be ordered.
8. Any changes/ additions will be considered change orders and will be quoted for approval prior to order.
9. It is the responsibility of the purchaser to confirm with the project’s designer and/or consultants that the items quoted are acceptable for use in the project.
10. Deposit is required (+cleared at bank) prior to ordering.

Delivery
11. Lead times are estimationsas provided by manufacturers. MASSIVE is not responsible for any extra costs / expense and/or penalty related to lead time related delays.
12. The execution of this contract, established by the acceptance of this quote, is subject to delays which are beyond our control. MASSIVE will not be held accountable for any delivery delay, or fees that could result from these delays.
13. MASSIVE will not assume responsibility for damage to the products caused by others, including factory, packaging, shipping, materials handling & installation (if by others).
14. Any extra delivery costs due to site conditions or specialty requirements of the productsare the responsibility of the purchaser unless otherwise stated in this proposal.
15. Once delivered, the products are the responsibility of the customer to ensure secure storage and to provide adequate protection for all products installed or not installed.

Installation (where applicable)
16. The installation of the products will begin once all documents necessary to install are approved in writing and received.
17. MASSIVE reserves the right to postpone installation due to weather conditions.
18. MASSIVE reserves the right to subcontract installation or any or all items.
19. Installation is assumed to be a single mobilization with continuous flow and access. Any interruption due to site conditions, site readiness, changes, etc., may be subject to additional costs.
20. Upon completion of installation, the purchaser is required to inspect with MASSIVE to note any deficiencies. Damage caused by others will not be accepted as deficient work, nor warrantied.
21. Screens (where applicable) will be provided at time of installation. If requested for separate delivery / installation of screens, additional costs will apply for storage, mobilization, equipment rental, etc.

Warranty
22. Any damages caused by use of installed products during construction are excluded from warranty.
23. MASSIVE warranty mirrors manufacturers warranty. Cancellation Policy
24. We understand that circumstances may change, and orders may need to be modified or cancelled. Please note that we work with third party suppliers and manufacturers who commence work upon receipt of deposits, which commits resources and materials costs to the project. Upon receipt of the deposit, this work is deemed to have commenced, and a cancellation fee will apply according to each supplier’s policy on cancellation and their progress to that point. In some cases where project schedules demand expedited orders or customizations, the order may not be refundable or cancellable.
